Welcome to Cattle Cast. Cattle Cast provides its website, podcasts, customer accounts and advertising services (together, the "Cattle Cast Services") subject to the following conditions. By visiting cattlecast.com, creating an account or buying advertising, you accept these conditions. Please read them carefully.
Privacy
Please review our Privacy Notice, which also governs your use of the Cattle Cast Services, to understand our practices.
Electronic communications
When you use the Cattle Cast Services or send us emails, text messages or other communications, you are communicating with us electronically. You consent to receive communications from us electronically, such as email, and by phone at the number you provide. You agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that they be in writing.
Copyright
All content included in or made available through the Cattle Cast Services, such as audio, episodes, text, graphics, logos, cover art and software, is the property of Cattle Cast or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, redistribute, re-upload or create derivative works from our episodes without our written permission, except for brief quotations with attribution.
Trademarks
"Cattle Cast," "Voices of the ag industry," the cow-and-microphone logo, show names and related graphics are trademarks or trade dress of Cattle Cast. They may not be used in connection with any product or service that is not Cattle Cast's, in any way likely to cause confusion, or in any way that disparages Cattle Cast. Other trademarks that appear in the Cattle Cast Services belong to their respective owners.
License and access
Subject to these conditions, Cattle Cast grants you a limited, non-exclusive, non-transferable license to access and make personal, non-commercial use of the Cattle Cast Services. This license does not include resale or commercial use of our content; collecting show or pricing information for competitive purposes; using data mining, robots or similar tools; or copying our site or content for the benefit of another business. Any unauthorized use ends the license granted here.
Your account
You are responsible for keeping your password confidential and for all activity under your account. You agree to provide accurate information, including your name, email and phone number, and to keep it current. You must be at least 18 to create an account or buy advertising. We may refuse service, close accounts, or remove content at our discretion, including if we believe an account is being used for fraud.
Podcast production services
- Starter Package. Booking a podcast includes a one-time Starter Package fee of $1,750, charged in full when you book. It covers the planning, consultation, design, intro and outro, and distribution setup described on our Starter Package page. Equipment purchases are not included.
- In-Person Studio Setup (optional add-on). If you add it when you book, the one-time fee of $9,500 is charged with your Starter Package. Cattle Cast sends one or two producers to set up your recording space at a single location within the contiguous 48 United States, on a date we schedule together. Travel and lodging for our team are included. Equipment is not included: we provide a custom gear list in advance, and you are responsible for purchasing it and having it on site before the visit. If you need to reschedule, give us at least 7 days' notice. The fee is non-refundable.
- Monthly production billing. Production is billed per episode, for the number of episodes per month you choose: $950 per episode for 1 a month, $850 per episode for 2 a month, or $750 per episode for 4 a month. By booking, you authorize Cattle Cast, through our payment processor Stripe, to charge the card you use at checkout the monthly amount on the start date you choose and on the same day of each month after that.
- 3-month minimum. Every booking includes a commitment of 3 consecutive monthly payments. You may not cancel before your 3rd monthly payment has been made, and you are responsible for all 3 payments.
- Automatic continuation and cancellation. After the minimum, billing continues month to month until you cancel. You can cancel at any time after your 3rd monthly payment from your account dashboard, or by contacting us. Cancellation takes effect at the end of the month you have already paid for, and you will not be charged again.
- No refunds. The Starter Package and all monthly payments are final and non-refundable, including for partial months and for episodes that are cancelled, postponed, or not recorded.
- Failed payments. If a monthly payment fails, we may retry the charge and may pause production until your account is current. Amounts owed for the minimum term remain due.
- Discount codes. Discount codes are issued at our discretion, can be used once per customer, have no cash value, and cannot be applied to a booking after checkout.
- Price changes. We may change monthly production prices after your minimum term with at least 30 days' notice by email. You may cancel before the new price takes effect.
- Advertising revenue sharing (optional). If you choose to allow advertising when you book, Cattle Cast may sell and manage ad space on your podcast. Advertising revenue that Cattle Cast collects for ads that run on your podcast is split 70% to you and 30% to Cattle Cast. You may choose to approve each advertiser before their ads run on your podcast, or to accept any advertiser Cattle Cast approves. Cattle Cast screens every advertiser under the standards in the Advertising campaigns section below. If an advertiser receives a refund, no revenue share is owed for that refunded amount. Your share is paid after Cattle Cast receives the advertiser's payment. You can change your advertising choices at any time by contacting us.
- Ownership. You retain ownership of your podcast, hosting account, distribution accounts, branding, and audience. You grant Cattle Cast administrative access to manage production and publishing. Platform approval times are controlled by Apple, Spotify, and other directories and are not guaranteed by Cattle Cast.
Advertising campaigns
- 12-month commitment, billed monthly. Every advertising campaign is a commitment of twelve (12) consecutive months. Prices are shown in U.S. dollars per month. By checking out, you authorize Cattle Cast, through our payment processor Stripe, to charge the card you provide the monthly price on the day you check out and on the same day of each following month, for a total of twelve monthly payments. Billing stops automatically after the twelfth payment; a campaign does not renew unless you book a new one.
- No early cancellation. You may not cancel a campaign before the end of its 12-month term. You are responsible for all twelve monthly payments, and if a payment fails we may retry the charge, pause your ads until the balance is paid, and seek the remaining payments owed for the term.
- Card updates. Keep your payment information current. If your card changes or expires, contact us and we will send you a secure link to update it.
- Scheduling. After you check out, we will contact you to confirm air dates. Start dates you request are preferences, not guarantees, and depend on episode schedules and availability.
- Ad materials. You are responsible for providing scripts, talking points and materials on time, and for making sure your claims are truthful, substantiated and lawful. You grant Cattle Cast a license to use your name, trademarks and materials to produce, air and promote your ad.
- Content standards. We may decline or edit any ad if we believe it is misleading, unlawful, offensive or not a good fit for our audience, and we will ask you for revised materials. Host reads are delivered in the host's own voice and words, based on your talking points.
- Advertiser approval and full refund. Every advertiser and ad is subject to approval by Cattle Cast, and, where a show's host has asked to approve advertisers, by that host. We reserve the right to decline any advertiser we believe does not reflect good moral standing, including, without limitation, any business, product, or message that is sexual in nature or that mocks, slanders, or disparages God or the Christian faith. If we or the host do not approve your business or ad, we will cancel your campaign and give you a full refund of every payment you made for it.
- No refunds otherwise. Except for a full refund when an advertiser is not approved, all payments are final and non-refundable. This includes payments for months in which an episode is cancelled, postponed or not released, for any reason. If an episode is cancelled, we may, at our discretion, run your ad in another episode, but we are not required to.
- No performance guarantee. Unless we agree otherwise in writing, we do not guarantee a specific number of downloads, listens, impressions, clicks or sales.
Cattle Cast+ membership
Cattle Cast+ is billed monthly, in advance, to the card you provide, and renews each month until you cancel. You can cancel at any time by emailing jordan@cattlecast.com; cancellation takes effect at the end of the month you have already paid for, and you keep access until then. Payments are non-refundable, including for partial months. Your private feed link is for your personal use only and may not be shared or published. We may change the monthly price with at least 30 days' notice by email, and you may cancel before the new price takes effect.
Your submissions
Information you send us through forms, email or your dashboard, such as sign-up details, messages and podcast links, must not be illegal, threatening, defamatory, infringing or otherwise objectionable. You must not impersonate anyone or send spam. You are responsible for anything you submit, and you confirm you have the right to share it.
Claims of intellectual property infringement
Cattle Cast respects the intellectual property of others. If you believe your work has been used in a way that constitutes infringement, contact us at jordan@cattlecast.com with a description of the work, where it appears in our Services, and your contact information.
Other businesses and links
Our Services link to third-party platforms such as Apple Podcasts, Spotify and YouTube, and to websites of our advertisers. We are not responsible for the content, products or practices of those parties, and your use of them is governed by their own terms.
Disclaimer of warranties and limitation of liability
The Cattle Cast Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Cattle Cast disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
Our shows discuss markets, animal health, finance and other topics for general information only. They are not financial, legal, veterinary or professional advice. Consult a qualified professional before making decisions for your operation.
To the fullest extent permitted by law, Cattle Cast will not be liable for any indirect, incidental, special, consequential or punitive damages, and our total liability for any claim relating to the Cattle Cast Services will not exceed the amount you paid us in the 12 months before the claim arose.
Indemnity
You agree to defend and hold Cattle Cast, its hosts and contractors harmless from claims arising out of the ads or materials you provide, or your breach of these conditions.
Applicable law
By using the Cattle Cast Services, you agree that the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles, govern these Conditions of Use and any dispute between you and Cattle Cast.
Disputes
If you have a concern, contact us first. Most issues can be resolved quickly by phone at 410-984-6830. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in the Commonwealth of Virginia, and you and Cattle Cast consent to jurisdiction there.
Site policies, modification and severability
We may change our Services, policies and these Conditions of Use at any time. Changes apply from the date they are posted on this page, and continued use of the Services means you accept them. If any of these conditions is found invalid or unenforceable, it will be severed and the rest will remain in effect. Our failure to enforce any condition is not a waiver.
